ASSEMBLY BILL 341 - MANDATORY COMMERCIAL RECYCLING

Assembly Bill 341 (AB 341) was adopted July 1, 2012. The legislation is designed to help meet California's recycling goal of 75% by 2020. This law requires California commercial enterprises, public entities that generate four or more cubic yards per week of waste, and multi-family dwellings with five or more units can take one, or any combination of the following actions in order to divert recyclable waste from the landfill:

Benefits of AB 341
AB 341 will reduce the amount of material going into local landfills while contributing to Solano County's economy. The Department of Resources Recycling and Recovery estimates that local jurisdictions, schools, and businesses will save $40 million to $60 million per year from 2012-2020, due to lower recycling costs versus disposal costs. A higher volume of recyclables will also create manufacturing and recycling jobs and help contribute to California's competitiveness.

ASSEMBLY BILL 1826 MANDATORY ORGANICS RECYCLING

Why Organic?

Mandatory recycling of organic waste is the next step toward achieving California's recycling and greenhouse gas (GHG) emission goals. Organic waste such as green and food materials are recyclable through composting, mulching, and anaerobic digestion, which can produce renewable energy and fuel. Greenhouse Gas (GHG) emissions resulting from the decomposition of organic wastes in landfills have been identified as a significant source of emissions contributing to global climate change.

Food waste includes solid, semi-solid, and liquid food such as fruits, vegetables, cheese, meat, bones, poultry, seafood, rice, pasta and oils.

AB 1826-Mandatory Commercial AB1826 Organics

Effective January 1, 2019, California Assembly Bill 1826 (AB 1826) mandates all businesses and Multi-Family Dwellings of 5 units or more, that generate 4 cubic yards or more of commercial solid waste "trash, recycling, and organics" per week are subject to mandatory organics recycling. Businesses can take one, or any combination of the following actions in order to divert compostable waste from landfill:

  • Source separate organic waste from other waste and participate in a waste recycling service that includes collection and recycling of organic waste.
  • Recycle its organic waste on site through such means as compost, anaerobic digestion, and/or, vermicomposting.
  • Self-haul its organic waste off site for recycling.

Recology Vallejo collects the following organic materials: food waste, including food-soiled paper, landscape and pruning waste, etc. However, Multi-Family Dwellings are not required to recycle food waste or food-soiled paper. SENATE BILL (SB) 1383 Short-Lived Climate Pollutants (SLCP): Organic Waste Methane Emissions

SB 1383 establishes targets to achieve a 50 percent reduction in the level of the statewide disposal of organic waste from the 2014 level by 2020 and a 75 percent reduction by 2025. The law grants CalRecycle the regulatory authority required to achieve the organic waste disposal reduction targets and establishes an additional target that not less than 20 percent of currently disposed edible food is recovered for human consumption by 2025. Businesses must to subscribe for organics recycling services with Recology right away. Please call Recology at (707) 5523110 to start service or get more information regarding costs and cart size options for food and/or green waste recycling.

If you believe that your business is exempt, you must complete and email the "Exemption Form" promptly to [email protected], and indicate the reason for your exemption clearly. You will be contacted by the City following the review of this exemption form regarding the status of your application. If approved, this exemption is effective for a five year period.

If your business is recycling organics materials via means other than the program provided by Recology, you are required to report your organics recycling to the City. Please complete and email the "Self Haul" form to [email protected]
